Predicted to be one of the most important issues in this election year, medical malpractice debates have continued to be a hot topic, drawing strong arguments from both sides of the table. In Florida, Florida medical malpractice awards caps were decided upon after three special sessions in 2003. The Florida legislature and Governor Jeb Bush compromised on a $500,000 per physician cap on pain and suffering damages in medical malpractice liability cases. The pain and suffering limit was raised to $2.5 million in cases involving death or catastrophic injury.
In July 2003, the Public Citizen consumer group issued a news release refuting Florida's "crisis" status. According to the advocacy group, new government data showed the number and amount of payments to Florida medical malpractice victims declined in the state in 2002, despite claims that frivolous, high payout Florida medical malpractice lawsuits were the cause for spikes in doctors' insurance premiums. The president of Public Citizen stated, "it's clear from these numbers that the insurance premium increases over the past year are not tied to lawsuits." Still, President Bush announced his call for a nationwide limit on pain and suffering awards in medical malpractice lawsuit cases as a way to cut health care costs.
