The medical malpractice debate is still split between democrats and republicans. In January 2004, President Bush blamed medical malpractice lawsuits for the rising health care costs; claming high malpractice premiums are forcing doctors out of business and preventing adequate patient care. There are estimates that tens of thousands of people die every year from preventable medical errors. While the majority of these mistakes are not intentional acts, families have suffered losses because of them and are entitled to compensation for their pain and suffering.
In Florida, medical malpractice awards caps were decided upon after three special sessions in 2003. The Florida legislature and Governor Jeb Bush compromised on a $500,000 per physician cap on pain and suffering damages in medical malpractice liability cases. The pain and suffering limit was raised to $2.5 million in cases involving death or catastrophic injury. If frivolous Florida medical malpractice lawsuits were in fact the driving force for spikes in doctors' insurance premiums, government data showing the number and amount of payments to Florida medical malpractice victims in 2002 declined is an inconsistent occurrence.
Currently, President Bush has renewed his efforts to limit medical malpractice awards, which would be enforced nationwide including Fort Lauderdale medical malpractice cases. The legislation would limit pain and suffering of medical malpractice awards to $250,000 and punitive damages to the same or twice the patient's actual amount of monetary loss
