Florida Birth Trauma

Florida birth trauma is an event that occurs during child birth which causes injury to the newborn or the mother. In some cases, Florida birth trauma is unavoidable, though many Florida birth trauma cases are preventable events. Florida birth trauma occurs in approximately two to seven of every thousand births. Florida birth trauma can cause minor and/or temporary damage to the infant or mother, or it may result in more serious and/or long term damage, including death.

There are several types of injuries that can occur as a result of Florida birth trauma. In some cases fetal or maternal risk factors may have been present, increasing the likelihood of a Florida birth trauma. Such factors may include: large fetal size, premature delivery, disproportional fetal head size, prolonged or difficult labor, maternal health problems or infections, and fetal health problems. When these factors are present, medical professionals have a duty to provide a high standard of care and take every step possible to avoid Florida birth trauma.

In some cases Florida birth trauma is caused, or contributed to, by medical malpractice. Medical malpractice is a legal term used to describe the failure of a medical professional to follow the accepted standards of practice for his/her profession, resulting in harm to a patient. When a doctor or other medical professional causes or fails to prevent Florida birth trauma, where an otherwise similarly situated medical professional could have avoided the Florida birth trauma, the medical professional can be held liable for any damages which result.

Several types of Florida birth trauma can be caused by medical negligence. A forceful or improperly executed vacuum extraction or forceps technique during labor can cause several types of Florida birth trauma injuries including: caput succedaneum (swelling and injury to the baby's scalp), cephalohematoma (bleeding under the cranial bones), bruising, facial paralysis, brachial palsy, fractures, and cerebral palsy. Any instance of improper care during pregnancy or childbirth that causes injury may be attributable to medical malpractice.

When medical malpractice is the cause of a Florida birth trauma case, the victims have the legal right to seek compensation for their losses. These victims have the legal right to file a Florida birth trauma lawsuit to seek relief from their losses. Related medical expense, loss of income, psychological suffering, and other damages can all be compensated through a Florida birth trauma lawsuit. A Florida birth trauma lawsuit is brought against the negligent medical professional in civil court. When insurance is involved, a Florida birth trauma settlement may be agreed upon or the Florida birth trauma case may go to trial.
